Terms of Service

These Terms of Service (“Terms”) govern your access to and use of https://nourishgreen.life (the “Site”), operated by Nourish Green LLC (“Nourish Green,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Eligibility and Use of the Site

  • You must be at least 18 years old to use the Site.
  • The Site is intended for individuals located in the United States.
  • You agree to use the Site only for lawful purposes and not to misuse or attempt to disrupt its operation.
  • You agree to provide accurate, current, and complete information when placing orders or creating an account.

Products

  • Our products consist of fresh microgreens classified as raw agricultural products.
  • We do not make medical, nutritional, or health claims about our products.
  • All products are perishable and should be consumed promptly after order fulfillment.

Orders, Delivery, and Pickup

  • Delivery is available only to addresses within our designated service areas, currently including Huntsville and The Woodlands, with future expansion to Willis and Conroe.
  • Pickup may be available at designated farmers markets or partner locations. Pickup locations and times are subject to change. You will be notified of changes when they affect your active subscriptions.
  • You are responsible for providing accurate delivery or pickup information. We are not responsible for issues resulting from incorrect or incomplete details.
  • Delivery dates and times are estimates and may be affected by weather, traffic, or other factors beyond our control.

Accounts

  • You may place orders as a guest or create an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts at our discretion.

Payments

  • All payments are processed securely through Stripe.
  • We do not store full payment card information on our servers.
  • Raw agricultural products are exempt from Texas sales tax.
  • Prices, delivery fees, and availability are subject to change (and we will notify you via email when changes affect active subscriptions).

Subscriptions and Saved Payment Methods

  • Subscriptions renew automatically unless canceled prior to the renewal date.
  • By starting a subscription, you authorize us to charge your payment method for recurring subscription invoices.
  • For logged-in users, payment methods may be securely saved by Stripe and used to charge applicable delivery fees on the scheduled delivery date, unless waived based on order total and delivery area.
  • You may manage or cancel subscriptions through your account or by contacting us.

Cancellations and Refunds

  • Due to the perishable nature of our products, all sales are final.
  • Refunds or credits may be issued at our discretion for issues such as damaged or incorrect orders if reported promptly.

Intellectual Property

All content on the Site, including text, images, logos, and design elements, is owned by Nourish Green LLC or its licensors and may not be used without prior written permission.

Disclaimer of Warranties

The Site and all products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Nourish Green LLC shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to the use of the Site or our products, including delays or interruptions beyond our control.

Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Walker County, Texas.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
